Terms of Service

§ 1. General Provisions

1. These Terms of Service define the rules for using services provided by Esaudrinfo with headquarters at Lorong Kuda 2, 71 & 73, Jln Kuda, Pekan Sibu, 96000 Sibu, Sarawak, Malaysia (hereinafter: "Service Provider").

2. These Terms apply to the following services:

  • Castle and historical site tours
  • Guiding services
  • Historical photography
  • Historical consultations

3. "Client" means a natural person, legal entity or organizational unit without legal personality that uses the Service Provider's services.

§ 2. Booking and Ordering Rules

1. Services can be booked:

  • By phone at +60168991395
  • By email at [email protected]
  • Through the contact form on the website

2. Booking requires providing:

  • First and last name
  • Contact details
  • Service date
  • Number of participants
  • Type of service

3. Booking confirmation is provided within 24 hours of application.

§ 3. Prices and Payments

1. Service prices are given in Polish złoty (PLN) and include VAT tax.

2. Payment can be made:

  • In cash on site
  • By bank transfer
  • By credit card

3. For groups over 10 people, a 30% deposit of the service price is required.

4. The Service Provider reserves the right to change prices. Price changes do not apply to already confirmed bookings.

§ 4. Cancellation and Withdrawal

1. The Client may cancel a booking:

  • More than 7 days before the date - no charge
  • 7-3 days before the date - 50% charge
  • Less than 3 days before the date - 100% charge

2. The Service Provider may cancel the service in case of:

  • Weather conditions preventing safe service delivery
  • Venue closure for reasons beyond the Service Provider's control
  • Fewer than 3 participants (applies to group tours)

3. If cancelled by the Service Provider, the Client receives a full refund.

§ 5. Client Responsibilities

1. The Client is obliged to:

  • Comply with visited venues' regulations
  • Follow the guide's instructions
  • Inform about any health contraindications
  • Maintain personal courtesy
  • Ensure their own and other participants' safety

2. The Client bears full responsibility for damages caused by themselves or accompanying persons.

§ 6. Service Provider Responsibilities

1. The Service Provider is obliged to:

  • Provide services according to description and agreements
  • Provide qualified guides
  • Ensure safety during the service
  • Inform about any program changes

2. The Service Provider is not responsible for:

  • Participants' personal belongings
  • Damages resulting from violation of these Terms
  • Changes caused by external factors

§ 7. Historical Photography

1. Photography services include:

  • Sessions at historical locations
  • Photo editing
  • Digital delivery of materials

2. Copyright to photos belongs to the Client after full payment.

3. The Service Provider may use photos for promotional purposes with the Client's consent.

§ 8. Historical Consultations

1. Consultations include:

  • Archival research
  • Historical expertise
  • Substantive advice
  • Material preparation

2. Consultation completion time is determined individually.

3. The Client receives a report of conducted research and consultations.

§ 9. Complaints

1. Complaints can be submitted:

  • Verbally on site
  • In writing to: Lorong Kuda 2, 71 & 73, Jln Kuda, Pekan Sibu, 96000 Sibu, Sarawak, Malaysia
  • By email to: [email protected]

2. Complaints should contain:

  • Client details
  • Problem description
  • Date and place of service
  • Expected resolution

3. Complaints are processed within 14 working days.

§ 10. Personal Data Protection

1. Personal data processing complies with applicable law.

2. Detailed information is available in the Privacy Policy.

§ 11. Force Majeure

1. The Service Provider is not responsible for non-performance or improper performance of services caused by force majeure.

2. Force majeure means extraordinary events that could not be predicted and prevented.

§ 12. Final Provisions

1. For matters not regulated by these Terms, the provisions of the Civil Code apply.

2. The court having jurisdiction over the Service Provider's headquarters is competent for dispute resolution.

3. These Terms come into force on the day of publication on the website.

4. The Service Provider reserves the right to change these Terms. Changes do not apply to already concluded agreements.
